Painting Company Wins Summary Judgment in Stuck Window Case

Melissa Wood Eisenberg and Scott J. Loeding successfully represented a painting company in a personal injury lawsuit.  The plaintiff was a resident of an apartment building where Murchison &Cumming's client recently painted the exterior of the building.  One evening plaintiff attempted to push open her window when both her hands went through the glass, resulting in severe lacerations.

Ms. Eisenberg and Mr. Loeding brought a motion for summary judgment demonstrating that there was evidence that the apartment windows stuck prior to any painting activity at the property and that there was no evidence that the windows were painted shut or that the painting company was negligent.  The Court granted the motion in its entirety resulting in a judgment in favor of the painting company.
