Senior Partner Guy R. Gruppie was quoted in the May 2, 2017 Law 360 report on the potential groundbreaking California Court of Appeal ruling in Cuevas v. Contra Costa County headlined, “Calif. Court’s ACA Ruling My Trim Med Mal Awards.” The article discussed the potential reach of the ruling in limiting future medical damages awards in catastrophic injury cases due to the admissibility of certain provisions of the Affordable Care Act, despite continued legislative wrangling over ACA.

The Cuevas ruling was a “breath of reasonable fresh air” in response to plaintiff expert life care plans that sometimes include grossly inflated projected expenses that rarely reflect actual health care costs, according to Gruppie.

“The Court of Appeal here is leveling the playing field so that jurors can be better informed and know more facts when they decide if damages in the form of future medical expenses should be awarded,” he said.
